ISLAMABAD: The Islamabad High Court on Friday reserved its verdict on the National Cyber Crime Investigation Agency (NCCIA)’s applications concerning the sentence suspension pleas filed by Iman Mazari and Hadi Chattha.
During the hearing, the NCCIA argued that the sentence suspension applications had been filed prematurely and were not maintainable under the law. The prosecution maintained that the requirements of Section 426(1A) had not been fulfilled.
According to the NCCIA’s stance, in cases where a sentence exceeds seven years, a request for suspension of sentence can only be considered after the convict has completed two years of imprisonment.
Iman Mazari and Hadi Chattha had each been sentenced to 17 years in prison.
The NCCIA requested the court to dismiss the sentence suspension applications, contending that Section 426(1A) is a mandatory legal provision and that no relief can be granted in violation of the law.

The court observed that it would first decide the NCCIA’s miscellaneous applications. Justice Azam Khan remarked that the preliminary legal objections would be decided before proceeding further.
The NCCIA also argued that if its applications were not heard first, they would become ineffective.
After hearing arguments on the NCCIA’s applications, the Islamabad High Court reserved its decision. The hearing on the sentence suspension applications concluded after both sides completed their arguments.
