Member of the National Assembly Sher Afzal Marwat has filed a petition seeking the restoration of Ali Amin Gandapur as Chief Minister of Khyber Pakhtunkhwa and requesting that the appointment of Sohail Afridi as the new chief minister be declared null and void.
According to details, a new and dramatic turn has emerged in Khyber Pakhtunkhwa’s political crisis as Pakistan Tehreek-e-Insaf leader Sher Afzal Marwat has approached the Federal Constitutional Court against the removal and resignation of former chief minister Ali Amin Gandapur.
In the petition, Marwat has requested the court to declare the de-notification of Ali Amin Gandapur illegal and to set aside the appointment of Sohail Afridi as the new Chief Minister of Khyber Pakhtunkhwa.
The petition states that Ali Amin Gandapur’s resignation was not voluntary. It claims that the resignation was obtained from him forcibly under intense political pressure.
Marwat has further claimed in the petition that Gandapur’s resignation was taken on the dictation of a single convicted and disqualified individual, which, according to the petition, has no legal status under the Constitution.
He argued that the act of de-notifying Ali Amin Gandapur by the governor or the relevant authorities was illegal and completely against the basic structure of the Constitution of Pakistan.
The petition has requested that the official notification issued for the appointment of Sohail Afridi as the new Chief Minister of Khyber Pakhtunkhwa be immediately cancelled and declared void.
It has also sought the restoration of Ali Amin Gandapur as Chief Minister of Khyber Pakhtunkhwa with full constitutional powers.
Sher Afzal Marwat further stated that all official and administrative decisions taken so far by the new setup as a result of this alleged unconstitutional change should be completely cancelled.
